The panel will focus on the specific practical impacts of the new Slovak Civil Code on insolvency and financial law, in particular the key changes and new risks it brings for creditors, debtors and financing. The discussion will address how the new legal framework may affect insolvency and pre-insolvency situations, as well as what these changes mean in practice for businesses, creditors and their advisors.

The panellists will focus on where the use of legal instruments borders on their abuse in insolvency proceedings. They will discuss, in particular, controlled bankruptcy, vexatious bankruptcy petitions, the use of (un)affiliated creditors, and the abuse of capital funds. From both a legal and economic perspective, they will examine the impact of these practices with the aim of identifying risk mechanisms and seeking ways to limit them in practice.
